Sandusky Case: Hearing Set May 9 for All Motions to Quash Subpoenas

All the major players in the Jerry Sandusky case will convene again Wednesday, May 9, at the Centre County Courthouse in Bellefonte.

That's when Judge John M. Cleland will hold a 1:30 p.m. hearing to address all motions to quash subpoenas, already filed or otherwise.

To date, motions have been filed by the Keystone Central School District, the Mifflin County School District and The Second Mile. Any similar motion filed by next Wednesday will be heard at the same time, Cleland said.

This past Friday, prosecutors said that Jerry Sandusky's attorney, Joe Amendola, was inappropriately using his subpoena rights and asked that the court restrict them.

Amendola denied any wrongdoing.

On Monday, Keystone Central School District filed a motion to have its subpoena quashed on the grounds that the records for which the defense is seeking, in regard to Victim 1, are private and can only be distributed with the student's consent, or the consent of the parent, if under 18 years old.

By Tuesday, two more motions had been filed. Mifflin County School District said records sought by the defense in regard to Victim 9 are private and protected by laws, such as FERPA and HIPPA. The defense served the school district with a subpoena in an attempt to get psychological, behavioral, and all administrative records in relation to Victim 9.

The Second Mile also asked to have its subpoena quashed, citing some of the reasons listed by Keystone Central School District.

Sandusky faces 52 counts of child sexual abuse, though he maintains his innocence. He awaits a June 5 trial.
