A downtown State College restaurant owes about $65,000 in unpaid rent and faces possible eviction, according to a local real estate company’s filing on Friday in Centre County Court.
BRGR is in default on its lease for 122 W. College Ave. and, as a result, property owner Calder Joint Venture “is entitled to recover possession of the premises,” attorney Kathleen Yurchak wrote in the complaint in confession of judgment for possession, which seeks to execute a contract clause in the event of default.
According to a letter sent by the property landlord and included in the filing, BRGR owner SRG State College LLC failed to make remittance on a repayment plan established at the start of the year and as of Feb. 26 was in default on the lease. The restaurant had until April 3 to pay the full balance of $64,993.01 or else Calder Joint Venture would “institute proceedings to take possession of the premises and seek all additional remedies…”
Representatives for the restaurant have not responded to a request for comment.
BRGR, which specializes in gourmet burgers and shakes, opened its first location outside of the Pittsburgh area in the former bank building on College Avenue in 2019. The State College location is the only remaining BRGR restaurant, after the company closed the last of its three Pittsburgh eateries in 2023.
Terms of the lease on the State College property included rent of $8,355 per month, or $100,380 per year, for the first five years beginning in 2020. In 2025, the rent is set to increase to $9,365 per month, or $112,380 per year through the next five years.
Calder Joint Venture’s complaint “demands judgment for possession against Defendant SRG State College, LLC … and an order for ejectment.” No hearings are currently scheduled.
