Attorneys representing one of Jerry Sandusky’s victims are asking to see millions of legal documents associated with the Sandusky child sex abuse scandal. The request is part of a lawsuit filed against Penn State by a man known as Victim 6.
The documents include the names of people Louis Freeh interviewed in his investigation and all the documents given to the original grand jury investigating Sandusky and top Penn State administrators. The attorneys for Victim 6 have served requests to the court for the production of these documents.
The attorneys are also asking for information about anyone who served as secretary to those administrators, including former university president Graham Spanier, former Athletic Director Tim Curley and former Senior Vice President for Finance and Business Gary Schultz.
Penn State is asking U.S District Judge Anita Brody to delay this suit until all criminal proceedings relating to Spanier, Curley and Schultz have ended. That request was made Oct. 7 and filed in the U.S. District Court in Philadelphia.
The university argues the items requested by Victim 6’s attorneys would hurt the university as well as the criminal proceedings of the administrators. The university says that because the defendants can’t participate in the discovery process the suit should be held until later.
“The University risks real prejudice if this action moves forward while parallel criminal matters proceed to trial,” the university’s attorneys write in their filing. “Because discovery cannot proceed efficiently and totally without involvement of the criminal defendants, it makes little sense to keep this case active.”
Curley, Schultz and Spanier are charged with perjury, failure to report, endangering the welfare of children, criminal conspiracy and obstruction of justice. All men maintain their innocence.
The University could not immediately be reached for comment.
Victim 6 filed his suit in January. Victim 6 testified against Sandusky at his criminal trial in 2012. The man says he was 11 when Sandusky coerced him to take a shower with him in 1998.
The original complaint in the suit says Sandusky his charity The Second Mile as a ‘hunting ground’ for his victims. The suit claims that the the university failed to report Sandusky to the authorities despite having knowledge of the alleged abuse.
Victim 6 is suing because he sees Penn State, as well as Sandusky and the Second Mile, as responsible for the abuse and the repercussions he says he suffered.
Sandusky, the former Penn State defensive coordinator, was convicted on 45 counts of child sex abuse. He is currently serving a sentence of 30 to 60 years in prison.
