Gary Schultz, through his attorney, is requesting his perjury and failure to report charges be thrown out.
Tom Farrell filed a motion in Dauphin County Court on Tuesday requesting the perjury charge be thrown out on the basis that there is no corroboration of Mike McQueary’s testimony that Schultz’s statements were false, the questions and answers concerning “seriousness and criminality” are ambiguous and the testimony at issue states opinions that are not capable of being proven false.
In the motion, Farrell argued that John McQueary’s statements from testifying at December’s preliminary hearing are too vague and imprecise to corroborate his son’s testimony. He also argued that Joe Paterno’s testimony to the Grand Jury supported Schultz’s version of events.
Tim Curley, the athletic director also charged with perjury and failure to report a crime, filed a motion through his attorney on Monday asking his charges be dismissed as well.
Schultz, a retired vice president for finance and business, is the only Penn State official who has admitted knowledge of the 1998 and 2002 allegations against Jerry Sandusky.
