Federal Subpoena Seeks Variety of Penn State Data; Board Records Targeted

A federal subpoena received by Penn State seeks a variety of records from the past 13 years, including those showing any payments made by PSU board members to the university itself or third parties on the university’s behalf.

Penn State itself released a copy of the subpoena on Friday. Dated Feb. 2, it was delivered to university General Counsel Cynthia Baldwin from Peter J. Smith, the U.S. attorney for the Middle District of Pennsylvania, and two assistant U.S. attorneys.

The three-page document, posted on the university website, seeks, in part, the preservation of computer hard drives used by Gary Schultz, a retired vice president; Tim Curley, on leave as athletic director; Graham Spanier, the immediate past president; and Jerry Sandusky, a former assistant football coach.

Smith also has sought the preservation of e-mail content and of ‘all source documents related to dealings with The Second Mile and any issue concerning allegations against or actions involving Jerry Sandusky.’

The subpoena cover letter makes reference to ‘The Second Mile/Sandusky/Penn State Federal Investigation.’ That would be separate from the state Office of the Attorney General investigation that yielded criminal charges against Sandusky, Schultz and Curley in November.

Sandusky, The Second Mile’s founder and accused of an extended pattern of child sexual abuse, has maintained that he is innocent. The judge overseeing his case has said he would like the anticipated trial to be held in May.

Schultz and Curley, both charged with perjury and failure to report in connection with the Sandusky matter, also have said that they are innocent.

Spanier has not been charged.

Penn State has received a subpoena for information about former assistant football coach Jerry Sandusky and several former administrators, The Philadelphia Inquirer reported late Thursday.

According to The Inquirer’s report, federal investigators filed the subpoena earlier this month as part of an ongoing child-sexual-abuse investigation. They have sought documents related specifically to Sandusky, former university President Graham Spanier, retired Senior Vice President for Finance and Business Gary Schultz and suspended athletic director Tim Curley, a spokeswoman told the newspaper.

She said Penn State is ‘fully cooperating’ with the investigators’ request, per The Inquirer’s report.

A federal inquiry would be one in a string of investigations at the university since state authorities charged Sandusky with child sexual abuse in November. Schultz and Curley, in related cases, are charged with perjury and failure to report. Spanier has not been charged.

Sandusky, Curley and Schultz have maintained that they are innocent.
