Convicted pedophile Jerry Sandusky is still in pursuit of a new case, this time taking it to the Superior Court of Pennsylvania.
Joe Amendola, Sandusky’s lawyer, filed the notice of appeal Thursday.
On Jan. 30, Senior Judge John Cleland denied Sandusky, 69, a new trial. Cleland presided over Sandusky’s June trial, where the former Penn State defensive coordinator was convicted on 45 of 48 charges arising from his rampant child sexual abuse over nearly two decades.
According to court documents, Sandusky and his defense team are appealing to the Superior Court with a similar argument they brought to the appeal in Bellefonte in January, including the allegation that the defense was not given enough time to prepare for trial.
During cross-examination, Amendoal testified that he would not have done anything different had the trial been pushed back as he requested.
Sandusky is currently serving a 30-60 year sentence in SCI Greene, a maximum-security prison about three hours away from State College. He is in a single cell for 23 hours a day.
