Penn State trustee Peter Khoury is officially withdrawn from the Paterno lawsuit against the NCAA, according to court documents filed Friday.
Khoury asked to be removed from the lawsuit in August. The lawsuit still includes Penn State trustees Ryan McCombie, Anthony Lubrano, Alvin Clemens and Adam Taliaferro, as well as Penn State professors, the Paterno family and former Penn State football players.
Khoury has said that he was threatened by board leadership if he did not drop his name from the suit, he would be removed from the university presidential search committee.
The university has said that the trustees suing as members of the Board of Trustees exceeds their authority as trustees.
The lawsuit hopes to remove the NCAA’s sanctions they imposed on Penn State as a result of the Jerry Sandusky sex abuse case.
A hearing will be held in the case at 10 a.m. Tuesday at the Centre County Courthouse in Bellefonte.
