An unnamed victim of Jerry Victim is still trying to get information out of Centre County Children and Youth Services, despite CYS’ attempts to quash his subpoena.
John Doe 6 is suing Penn State and Sandusky in federal court, and he wants CYS employee John Miller to testify and provide documents about a 1998 investigation involving himself and Sandusky. CYS has opposed that request, but a proposed compromise may bring the fight to an end.
After a conference between lawyers for both sides yesterday, the victim’s attorney has submitted a modified request he claims is “satisfactory to CYS as well as the parties.”
The proposed order still asks for Miller’s testimony, and it still requests various records from the agency. However, the proposal also narrows down the scope of the request to “testimony and documents, if any exist, that are responsive to [the] subpoena to the extent that such testimony and documents relate to [the victim].”
John Doe 6 will also agree to reveal his real name to CYS so they can search for documents and records that specifically relate to his case.
CYS attorney James Johnson opposed the original subpoena because he says releasing records involving minors violates various Pennsylvania confidentiality laws. But when Penn State attorneys filed court documents opposing CYS’ position, they pointed out that “the subject of a report” is allowed to request access to that report.
CYS has not yet responded to the new proposal from John Doe 6. Attorneys for both sides did not immediately return requests for comment.
Another document was filed in the case alongside the proposed order, but it is under seal and unavailable to the public. A followup conference in the lawsuit is scheduled for June 9.
