Counsel for former Penn State Vice President of Finance and Business Gary Schultz is asking the university’s Board of Trustees to delay its decision on renaming an on-campus child care center that shares Schultz’s name.

Tom Farrell wrote in a letter dated Sept. 10 that renaming the center would compromise the ‘American tradition of presuming citizens innocent until and unless proven guilty after a fair trial.’

Schultz was charged with perjury and failure to report by the Attorney General’s office in November in connection with the Jerry Sandusky child sex abuse scandal. Attorneys for Schultz and former Penn State athletic director Tim Curley, who faces the same charges, are seeking a dismissal of the charges.

Their trial is scheduled to start Jan. 7.

Penn State said earlier this week the Gary Schultz Child Care Center could be renamed the Child Care Center at Hort Woods at the trustees’ scheduled meeting Friday at the Nittany Lion Inn.

‘The renaming of the child care center will unfairly and precipitously paint Gary as guilty before trial,’ Farrell wrote. ‘Deferring your decision for the few short months until the verdict in Gary’s trial will not harm the university or its constituents.’
