Jerry Sandusky is still trying to have The Second Mile’s insurer pay for his legal proceedings despite a judge’s ruling the company does not have to cover those costs.
An appeal was filed in the U.S. Middle District Court Monday. It’s an effort to overturn a court decision that says the Federal Insurance Company does not have to pay fees linked to criminal and civil cases filed against Sandusky.
Attorneys for Sandusky don’t explain why they are appealing the decision in the most recent court filing.
Chief Judge Yvette Kane ruled March 1 in favor of Federal Insurance Company. Kane wrote in her decision that the claims filed against Sandusky were not a result of anything that occurred during his tenure “as an employee or executive at The Second Mile,” making his conduct “beyond the scope” of the insurer’s coverage.
Kane also denied Sandusky’s claim that he needed more time to go over material provided by the insurance company to properly oppose it.
Sandusky, 69, is serving a 30-60 year sentence for his sex crimes in a maximum-security prison.
