The State Attorney General is now trying to stop former Penn State President Graham Spanier from getting his hands on materials Spanier’s attorneys say are necessary for his trial.
Prosecutors filed last Wednesday to request that the Dauphin County Court deny Spanier’s request for a bill of particulars.
The attorney general’s office argues the request should be denied because Spanier already has the grand jury presentment and other discovery materials. The attorney general’s office says these items should be sufficient to “detail the factual basis for the charges.”
Spanier requested a bill of particulars in September. Spanier is asking for information that would show he violated an obligation to supervise the children former Penn State Defensive Coordinator Jerry Sandusky was convicted of abusing.
Former Athletic Director Tim Curley and former Interim Senior Vice President for Finance and Business Gary Schultz have also filed similar requests for bills of particulars. All three men are charged with covering up allegations of child sex abuse against Sandusky.
Sandusky was convicted on 45 counts of sexually abusing children he met through his charity, The Second Mile, and is currently serving a sentence of 30 to 60 years.
Spanier Curley and Schultz have a pretrial conference scheduled for Dec. 17 to Dec. 20 at the Dauphin County Courthouse in Harrisburg.
All three men maintain their innocence and vow to vigorously fight the charges in court.
