Mextorf Waives Preliminary Hearing, Faces Formal Arraignment

Former State College Superintendent Richard Mextorf, charged with DUI and related offenses, has waived his right to a preliminary hearing, court documents show.

Mextorf, 48, of Port Matilda, had been scheduled to appear for his preliminary hearing Tuesday in Lock Haven before District Judge Joseph L. Sanders III. But on Dec. 28, he filed materials to waive that part of the judicial process, according to court paperwork.

The Centre Daily Times reported on the development earlier Monday.

Court documents indicate that Mextorf next will face a formal arraignment at 8:30 a.m. Jan 24 in the Clinton County Court of Common Pleas.

Meanwhile, until the final disposition of the case, Mextorf is not allowed to enter establishments that serve alcohol beverages, according to a criminal docket. He also is forbidden from drinking entirely, it shows.

Mextorf’s listed attorney is State College-based Joseph Amendola.

A Penn State alumnus, Mextorf became superintendent of the State College Area School District in July 2009, succeeding Patricia Best upon her retirement. He tendered his resignation on Dec. 4, after he was charged with DUI and other violations in connection with a Nov. 18 traffic incident.

In that incident, reported in Porter Township, Clinton County, Mextorf’s blood-alcohol level was recorded at 0.316 percent. The threshold for DUI in Pennsylvania is 0.08 percent.

State College’s assistant superintendent, Michael Hardy, has since been named interim superintendent while the school district seeks a new chief executive.
