Jerry Sandusky Moves Ahead With New Appeal

Jerry Sandusky wants another day in court, and he just might get it.

McKean County Senior Judge John Cleland, who is specially presiding over the case, gave the former Penn State assistant football coach the go ahead to file a post-conviction relief petition with the court.

Sandusky, who was convicted as a serial molester of young boys in 2012, must file his appeal by May 6.

Cleland filed his scheduling order on Wednesday after a confidential meeting with Sandusky’s attorney and state prosecutors. The meeting was likely held behind closed doors because Sandusky has been given permission to file his appeal under seal, so few details about the appeal have been released.

Sandusky’s attorney, Al Lindsay, first asked the Centre County Court of Common Pleas for permission to file a sealed appeal earlier this month, which the court allowed. Sandusky’s appeal will reportedly be based, at least in part, on grand jury testimony that has not been made public.

Sandusky was convicted on 45 counts of child sex abuse and sentenced to 30 to 60 years in state prison in 2012. He has since attempted two failed appeals, one in superior court, the other in the state supreme court.

Lindsay says Sandusky may be able to attempt an appeal to federal court if his post-conviction relief petition fails, but Lindsay declined to go into greater detail about that possibility because “we’re not at that point yet.”

He also declined to offer further comment on the content of Sandusky’s current appeal.
