Judge John Cleland signed an order on Tuesday granting Jerry Sandusky’s defense team its request for an evidentiary hearing – an initial step as its works toward an appeal of his conviction.
On Thursday, Joe Amendola said his defense team deserves time to present testimony and exhibits in an effort to buffer its argument that the defense’s right to due process as granted by the Constitution was violated when Sandusky was not granted a continuance before his June trial, something the defense filed for several times.
The hearing is scheduled for 9:30 a.m. on Jan. 10 in Bellefonte. Cleland previously scheduled a post-sentence motions hearing for the same date.
Sandusky, 68, is seeking an appeal of his June 22 conviction. He was found guilty of 45 of 48 counts of child sexual abuse and is currently serving his 30-60 year sentence in SCI Greene, a maximum security prison, where he is housed in a single cell for roughly 23 hours a day.
